FAQs

The information provided on this page is for general informational purposes only and does not constitute legal advice. Every case is different, and results depend on the specific facts and circumstances of your situation. Past case results do not guarantee or predict similar outcomes in future cases.

About Your Case

Do I Have a Case?
Every situation is unique, and the best way to find out is to speak with one of our attorneys. We offer free consultations where we'll listen to your story, review the details of your accident, and give you an honest assessment of whether you have a valid claim. There's no obligation and no pressure.

How Much Is My Case Worth?
The value of your case depends on several factors including the extent of your injuries, medical expenses, lost wages, and the impact on your daily life. We can't give you an exact number until we understand your full situation, but we'll work to maximize your compensation based on what we can prove in damages and liability.
What if the Other Person Doesn’t Have Insurance?
Don't assume you're out of options. We look at all available insurance coverage to see how we can assist you—this may include your own policy, commercial property insurance, or other sources. We've helped clients who were turned down by other firms because there appeared to be no coverage. We thoroughly investigate every possible avenue for your recovery.
Do I Have to Sue the Other Person?
Not necessarily. We handle the claim process for you first, and then we decide together if a lawsuit is necessary. Many people think pursuing a claim means they're suing someone, but a claim and a lawsuit are two different things. We guide you through the claims process, dealing with insurance adjusters on your behalf. Most cases resolve without ever going to court. If litigation becomes necessary, we'll discuss the additional time involved and you'll be part of that decision. You're always in the driver's seat.

Costs & Fees

Do I Have to Pay Anything Upfront?
No. We work on a No Win, No Fee - Contingency Fee Basis. This means you pay no attorney fees unless we recover compensation for you. You have enough on your plate worrying about your vehicle, work, and medical care. If we need to conduct investigations or obtain paperwork, you will not be charged upfront for this work. We advance these costs, and they are reimbursed from your settlement only if there is a recovery. If there is no recovery, you owe nothing for attorney fees or costs.
Will My Insurance Rates Go Up if I File a Claim?
If you are not at fault, your insurance rates should not increase. You pay your insurance premiums to protect you and help you in situations exactly like this. Florida is a no-fault state, and filing a claim when you're not responsible for the accident should not impact your premiums.
Will I Have Any Out-Of-Pocket Expenses?
It depends on your insurance coverage. If you selected a deductible, you have self-insured for that amount. We'll walk you through your options—it could be your own carrier or the other party's insurance that covers your expenses. If the other party acknowledges fault right away, that may help you avoid paying out of pocket. Every situation is different, but we'll explain exactly what to expect.

The Process & Timeline

How Long Will My Case Take?
Your case begins from the moment the accident occurred. On average, personal injury cases take time because they include treatment time. However, each situation is different. While we work on investigating your case and gathering all necessary information, one thing we cannot control is the time it takes for you to receive the medical treatment you need. Once your doctor determines you've reached maximum medical improvement, your legal team will create a demand and move the case forward. More complex injuries naturally take longer.
Why Does It Take So Long to Get a Settlement?
Several factors affect the timeline. First, we need to wait until your medical treatment is complete or your doctor says you've recovered as much as you're going to. This protects you—settling too early could mean you don't get compensated for future medical needs. Additionally, Florida law gives insurance carriers 30 days to acknowledge a demand and 90 days to respond. We stay on top of these deadlines and push for resolution as quickly as possible while still protecting your interests.
What Is the Claims Process Like?
We handle the entire claims process for you. You won't have to worry about speaking with insurance adjusters—we manage all communications and work in your best interest to get the best possible outcome. Adjusters are trained professionals working for a company focused on ending claims quickly and cheaply. Having an experienced attorney levels the playing field and prevents adjusters from pressuring you into decisions that aren't in your best interest.

Medical Treatment & Bills

How Do I Pay for Medical Treatment After an Accident?
If it's an auto accident, your Personal Injury Protection (PIP) coverage is primary. PIP pays for 80% of the fee schedule amount. If you have health insurance, that serves as secondary coverage. If you don't have insurance or have limited coverage, we work with physicians who can help. One benefit of having an attorney is that medical professionals will often wait until your case resolves rather than requiring upfront payment, because they know they'll get paid when your case settles. Talk to us about your situation so we can see how we can help you with this.
Why Do I Have to Pay Anything if the Accident Wasn’t My Fault?
We understand the frustration. Florida is a no-fault state, which means the legislature decided that if you own a car in Florida or live with a relative who does, your own policy helps cover your initial medical expenses regardless of who caused the accident. This system was designed to ensure accident victims get quick access to care. We negotiate all medical bills at the end of your case to reduce what you owe and maximize what you take home from the settlement.

Working With Our Team

Will I Always Know Who’s Handling My Case?
Absolutely. You will always know who you're dealing with. You'll never be told your case has been reassigned to someone you've never met. You'll have a relationship with your attorney from beginning to end, and you can always speak with a professional lawyer—not just a receptionist or assistant. We get to know our clients personally and provide individualized service.
What if I’ve Had a Bad Experience With Attorneys Before?
We understand, and we'd like to know what happened so we can address your concerns. Many clients come to us after frustrating experiences elsewhere, often citing poor communication as the main issue. At Florida Advocates, communication is a priority. You'll speak directly with your attorney, you'll always know the status of your case, and you'll never feel like just a number. Our firm is like a family—both internally and in how we treat our clients.
Will You Keep Me Updated on My Case?
Yes. Regular communication is one of our core commitments. We know that lack of updates is one of the biggest frustrations clients have with attorneys and insurance companies. We'll keep you informed throughout the entire process so you're never left wondering what's happening with your case.

Dealing With Insurance Companies

Why Do Insurance Companies Deny Claims?
Insurance companies are in business to make money, not give it away. Denied claims are common, especially in premises liability cases. That's why you need an attorney who can apply pressure and formally request they review their decision. Insurance companies have up to 60 days to respond to such requests. Having experienced legal representation often makes the difference between a denial and a fair settlement.
The Insurance Company Isn’t Calling Me Back. What Should I Do?
Unfortunately, some insurance companies make it intentionally difficult to get a response. Some don't have fax lines, only accept communication via voicemail or mail, and investigate every claim extensively—even when liability is clear. This is their strategy to discourage people from pursuing what they're owed. When you have an attorney, we handle all insurance communications and know how to navigate these tactics.

What to Expect

What if I’m Worried I Won’t Fully Recover From My Injuries?
We work to the best of our ability to get you the compensation you need to help you recover. Florida law recognizes different levels of injury, including permanent injuries where you may have ongoing pain. Our goal is to help you through the process and ensure your medical providers document everything properly. We'll work with you to make sure your communication with your doctors accurately reflects how your injuries affect your daily life—this documentation is crucial if your case goes further.
What if I’m Missing Work or Worried About Losing My Job Due to Medical Appointments?
Documentation is key. If you're missing work due to your injuries, we need records from your doctor supporting this. If you've been terminated, ensure you have documentation showing your injuries, medical appointments, and the circumstances of your job loss. We can include lost wages in your claim, and in some cases, we can allocate PIP funds toward wage loss instead of just medical expenses.
Do You Handle Property Damage Claims?
If your property damage is a house or a business, we have a property damage division, If it is for your vehicle, we do not represent you for that kind of property damage, but we will help guide you through the process. We want you to deal with the insurance company directly for property damage so that process moves swiftly, but we're here to support you and answer questions along the way.
